1. Introduction
Welcome to Cowa Market Hub. These Terms and Conditions govern your access to and use of the Cowa website, marketplace, products and services.
Cowa Market Hub provides an online platform through which customers can discover and purchase products and services offered by Cowa and independent third-party sellers, as applicable.
By using the website, creating an account, registering as a seller or placing an order, you agree to the terms applicable to your activity. If you do not agree, please discontinue use of the relevant services.
2. Products and services
Cowa Market Hub may offer or facilitate access to:
- Digital products and downloadable materials.
- eBooks and printed books.
- Online courses, training and educational resources.
- Event tickets and training events.
- Coaching and consultation services.
- Clothing and fashion products.
- Electronics, home appliances and other physical goods.
Product availability, pricing, delivery arrangements and applicable conditions may vary by seller and product listing.
3. Customer accounts
Customers must provide accurate information when creating accounts and placing orders. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, subject to applicable law.
Notify Cowa promptly if you suspect unauthorised access to your account.
Cowa may restrict or suspend accounts involved in fraud, abuse, security breaches or serious violations of these terms, subject to applicable law.
4. Seller responsibilities
Third-party sellers are responsible for ensuring that their listings are accurate, lawful and not misleading.
Sellers must have the necessary rights to sell their products and must provide products and services that correspond to their descriptions.
Sellers are responsible for fulfilling orders, providing agreed services, observing applicable consumer protection requirements and complying with Cowa’s Vendor Agreement.
Cowa may review listings and remove products that violate its rules or applicable law.
5. Prices, orders and payment
Prices are displayed on the relevant product or service listing. Any applicable delivery charges and taxes should be disclosed as appropriate before the customer completes the purchase.
Customers may pay using the payment methods made available at checkout, which may include M-Pesa through IntaSend.
An order is subject to successful payment confirmation and any applicable fulfilment requirements. Customers should not treat a payment request, pending transaction or screenshot as proof of successful payment without confirmation.
If a payment fails, is duplicated or is confirmed without the corresponding order being recorded correctly, contact Cowa for assistance.
6. Cowa commission and seller earnings
Unless otherwise disclosed or agreed in writing, Cowa’s intended marketplace commission is 10% of the applicable sale amount, with 90% allocated to the seller before any separately agreed deductions, refunds, reversals or applicable adjustments.
The precise commission base, treatment of taxes, shipping charges, transaction fees and refunds will be governed by the applicable listing terms, Vendor Agreement and Payment, Commission and Vendor Payout Policy.
The allocation of seller earnings in the marketplace does not mean that funds have already been transferred to the seller.
7. Digital products and intellectual property
Digital products may be supplied through downloads, account access, email or another method stated in the listing.
Customers must respect the copyright, licence terms and usage restrictions applicable to each digital product. Purchasing a digital product does not automatically transfer its copyright or grant unrestricted redistribution rights.
Sellers must not upload or sell material they do not have permission to distribute.
8. Physical products, delivery and services
Physical products are subject to the delivery arrangements stated in the relevant listing and Cowa’s Shipping and Delivery Policy.
Courses, events, coaching and consultations are subject to the schedule, access conditions and service description supplied by the seller.
Customers should review product descriptions, sizes, specifications, schedules and other material details before purchasing.
9. Refunds and cancellations
Refunds, returns, exchanges and cancellations are governed by Cowa’s Refund and Cancellation Policy, the relevant product terms and applicable Kenyan law.
Nothing in these terms removes consumer rights that cannot lawfully be excluded.
Customers should contact Cowa promptly when a product is defective, materially misdescribed, undelivered or otherwise subject to a complaint.
10. Prohibited activities
Users must not:
- Use the marketplace for fraud or unlawful activities.
- Sell counterfeit, stolen, prohibited or infringing products.
- Publish deceptive product descriptions or false claims.
- Attempt to access another person’s account without authorisation.
- Interfere with website security or marketplace operations.
- Upload malicious files or misuse customer or seller information.
- Manipulate orders, payments, reviews or commissions.
11. Website availability and security
Cowa will take reasonable steps to maintain the marketplace but cannot guarantee uninterrupted access or that the website will always be free of technical errors.
Maintenance, security incidents, payment-provider interruptions or other circumstances may temporarily affect availability.
Nothing in this section excludes responsibility that cannot lawfully be excluded.
12. Complaints and disputes
Customers and sellers should first contact Cowa at admin@cowa.co.ke to report complaints or seek assistance.
Cowa will review complaints and may request order numbers, transaction references, relevant correspondence or other information reasonably necessary to investigate.
These terms are governed by the laws of Kenya, subject to applicable mandatory consumer rights and legal requirements.
13. Privacy and personal information
Cowa handles personal information in accordance with its Privacy Policy and applicable data protection laws.
Customers and sellers should review the Privacy Policy to understand how their information may be collected, used, stored and shared with service providers where necessary to operate the marketplace.
14. Changes to these terms
Cowa may update these terms to reflect changes in its services, marketplace operations or legal obligations.
The revised terms will be published on this page with an updated effective date. Where required by law, users will be given appropriate notice or asked to provide consent.
